Courts will usually try to balance the rights of both parents in making a determination about custody. However, the “best interests of the child” — the legal standard in New York, and in most other jurisdictions — usually trumps everything and everyone.
Legal Custody determines whether, and under what circumstances, parents have a say in the significant events in a child’s life, including child-rearing decisions. These can include everything from choice of schools, religious upbringing, nutritional decisions, choice of healthcare providers, and participation in extra-curricular activities.
Physical Custody determines the circumstances and the periods of time a child can or will spend with either parent. The terms of any custody can involve joint physical custody, or sole physical custody. Generally, though, unless the Court decides that one parent is utterly ill suited to have any custodial rights, joint physical custody is generally the arrangement that prevails. Even then, one parent will often be deemed to have primary physical custody (for instance, a Custody Order may provide as follows: “Mrs. Jones shall be deemed to be the primary physical custodian for the purpose of determining the child’s school district”, or words to that effect). Thus, even when a court awards one parent primary physical custody, it will still award the other parent visitation (often referred to as “access”), setting schedules to see the child at regular intervals, including holiday access, and sometimes with restrictions as to time, settling, and can even require that there be a “supervisor” present during the visitation periods.
